Specific clauses, governing law, jurisdiction, and limitation of liability provisions must be validated by a lawyer admitted to practice in the relevant jurisdictions before public release.
    Important — please read this first. Raxha is a supplemental personal safety tool. Raxha is not a substitute for emergency services (such as 112 in India, 911 in the United States, 999 in the United Kingdom, or your local emergency number). Raxha is not a medical device and does not diagnose, treat, cure, or prevent any illness or condition. Sensor-based detections are best-effort and may produce false positives or false negatives. If you are facing an emergency, contact your local emergency services directly.

    1. Acceptance of These Terms

    These Terms of Service ("Terms") form a binding agreement between you ("you", "your", or "User") and Raxha ("Raxha", "we", "our", or "us"). By creating an account, installing, or using the Raxha mobile or wearable application (the "App") or any associated services (together, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not use the Service.

    2. About Raxha

    Raxha is a personal safety application that runs on your smartphone and paired smartwatch. The Service provides best-effort safety features that may include:

    • Active monitoring during periods you choose to enable, using device sensors and on-device processing to recognize patterns associated with potential distress
    • Sending alerts containing your location and event details to emergency contacts you designate
    • Sharing your monitoring status and last known location with members of a family group you create
    • Recording trips you take and providing trip summaries

    The specific features available to you may change over time as Raxha is updated. Raxha is offered as a supplement to, not a replacement for, traditional emergency services and personal vigilance.

    3. Eligibility

    • Adults only (18+). You must be at least 18 years old to create or use a Raxha account. The Service is not directed to, and may not be used by, anyone under 18. (Parent-managed accounts for minors, with verifiable parental consent, are planned for a future release and are not offered at this time.)
    • Capacity to contract. You represent that you have the legal capacity to enter into a binding agreement in your jurisdiction.

    4. Critical Safety Disclaimers

    4.1 Not a substitute for emergency services

    Raxha is a supplemental tool. It is not a replacement for, and does not connect you directly to, emergency dispatchers, police, fire, ambulance, or any other emergency response service. In an emergency you must contact your local emergency services using a phone, recognized emergency button, or other reliable means. We do not guarantee that any alert, message, or notification originating from the Service will reach any specific recipient or any emergency authority within any specific time, or at all.

    4.2 Not a medical device

    Raxha is not a medical device and is not intended to diagnose, treat, cure, prevent, or monitor any disease, condition, or injury. Health-related metrics shown by the Service are for general awareness only. They are not clinical readings and must not be used to make medical decisions. If you have a health concern, consult a qualified healthcare professional.

    4.3 Best-effort detection

    Raxha's safety detections rely on smartphone and smartwatch sensors, on-device processing, and connectivity infrastructure that is outside our control. Detections may produce false positives or false negatives. Factors including but not limited to low battery, lost connectivity, sensor drift, body position, environmental conditions, and software bugs can cause the Service to behave unexpectedly. You must not rely on Raxha as your sole or primary safety mechanism.

    4.4 Connectivity required for cloud features

    Several Service features (alert delivery to contacts, family group visibility, trip backup, account login) require a working internet connection on at least one of your devices. The Service may degrade or stop working entirely if your device is offline, in airplane mode, has insufficient battery, or is in an area without cellular or Wi-Fi coverage.

    4.5 You remain responsible for your safety

    You agree to use common sense, situational awareness, and traditional safety practices, and to not place yourself in dangerous situations on the assumption that the Service will protect you.

    5. Account Registration and Security

    • You agree to provide accurate and complete information during registration and to keep your account information current.
    • You are responsible for maintaining the confidentiality of your sign-in credentials (email, password, phone number, or other authentication factors) and for all activity under your account.
    • You must notify us immediately at admin@raxha.app if you suspect any unauthorized use of your account.
    • We are not liable for any loss or damage arising from your failure to safeguard your credentials.

    6. Acceptable Use

    You agree that you will not:

    • Use the Service for any unlawful purpose, including stalking, harassment, surveillance without consent, or any conduct that would violate the rights of any other person
    • Add anyone as an emergency contact or family group member without their knowledge or, where required by law, their consent
    • Submit false emergency alerts, spam, or content that you know to be false or misleading
    • Attempt to reverse-engineer, decompile, or extract the source code of the App or any part of the Service, except where such restriction is prohibited by applicable law
    • Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying infrastructure
    • Use the Service in a way that could harm or impair its operation or the experience of other users
    • Use automated means (bots, scrapers, scripts) to access the Service except as expressly permitted in writing by us
    • Resell, sublicense, or commercially exploit the Service without our prior written consent

    7. Pricing and Subscriptions

    The core Service is currently offered free of charge. We may, in the future, introduce paid plans, premium features, or in-app purchases. If we do, we will give you advance notice and an opportunity to review and accept the applicable pricing terms before any charge is made. Continued use of paid features will be governed by the pricing terms presented to you at the time of purchase, which form part of these Terms.

    8. Intellectual Property

    The App, the Service, and all associated trademarks, logos, designs, source code, models, content, and documentation are owned by Raxha or our licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for personal, non-commercial use in accordance with these Terms. No other rights are granted, expressly or by implication.

    9. Your Content and User Data

    You retain ownership of personal information you provide to the Service (for example, your profile, emergency contacts you choose to add, family group membership, and trip records). You grant Raxha a limited, worldwide, royalty-free license to host, store, transmit, and process this information solely for the purpose of providing, securing, and improving the Service, in accordance with our Privacy Policy. You represent and warrant that you have the right to share any information you provide and that doing so does not violate the rights or privacy of any third party.

    10. Privacy

    Our handling of your personal information is described in the Privacy Policy, which is part of these Terms. By accepting these Terms you also acknowledge that you have read and accept the Privacy Policy.

    11. Disclaimer of Warranties

    The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, Raxha disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. Without limiting the foregoing, we do not warrant that:

    • The Service will detect every emergency, will detect emergencies accurately, or will detect them in any specific timeframe
    • Alerts will be delivered to any specific recipient, in any specific timeframe, or at all
    • The Service will be available, secure, or free of bugs at all times
    • Any health, location, or activity information shown is accurate or reliable for any purpose other than general awareness

    Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply only to the maximum extent permitted by law.

    12. Limitation of Liability

    To the maximum extent permitted by applicable law:

    • Raxha and its officers, directors, employees, contractors, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, personal injury, emotional distress, or any other intangible loss, arising out of or in connection with your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.
    • Our total cumulative liability to you for any and all claims arising out of or relating to these Terms or the Service, regardless of the form of action, is limited to the greater of (i) the amounts you have actually paid to Raxha for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) one hundred United States dollars (USD 100), or its equivalent in your local currency.
    • Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law (including liability for gross negligence, willful misconduct, or fraud).

    You acknowledge that the Service is not designed for, and we have not priced it for, scenarios in which Raxha could be exposed to unlimited liability. The above caps reflect a fair allocation of risk between you and us given the nature of the Service.

    13. Indemnification

    You agree to indemnify, defend, and hold harmless Raxha and its officers, directors, employees, contractors, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

    • Your use or misuse of the Service
    • Your violation of these Terms or any applicable law
    • Your violation of the rights of any third party (for example, adding an emergency contact without their permission)
    • Any content or information you submit through the Service

    14. Termination

    • By you. You may terminate your account at any time by opening the App and selecting About → Delete Account. Deletion is permanent and removes your profile, monitoring history, location, family group membership, and emergency contacts from our cloud database, as further described in the Privacy Policy.
    • By us. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, that your use poses a security or legal risk, or that we are required to do so by law.
    • Effect of termination. Upon termination, your license to use the Service ends. Sections that by their nature should survive (including Sections 8, 9, 11, 12, 13, 16, and 17) will survive termination.

    15. Modifications to the Service and to These Terms

    We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time, including to reflect changes in the law, in our practices, or in the features we offer. When we make material changes, we will:

    • Update the "Effective Date" and "Version" at the top of this page
    • Notify you in-app on next launch and require you to accept the updated Terms before continuing to use the Service

    Continued use of the Service after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree, you must stop using the Service and may delete your account as described in Section 14.

    16. Governing Law and Jurisdiction

    These Terms and any dispute arising out of or relating to them or to the Service are governed by the laws of India, without regard to its conflict-of-law rules. Subject to Section 17 (Dispute Resolution), the courts located in Bengaluru, Karnataka, India will have exclusive jurisdiction over any claim that is not subject to arbitration. If you are using the Service from outside India, you remain responsible for compliance with applicable local laws. The above choice of law and jurisdiction does not deprive you of the protection of any mandatory consumer-protection rules of your country of residence that cannot be derogated from by agreement.

    17. Dispute Resolution

    • Informal resolution. Before filing any formal claim, you agree to contact us at admin@raxha.app with a description of your concern. We will attempt to resolve the matter in good faith within 30 days of receipt.
    • Arbitration (where permitted). If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms, the Service, or your relationship with Raxha that cannot be resolved informally will, where permitted by applicable law, be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996 of India (as amended). The seat of arbitration will be Bengaluru, Karnataka, India. The language of the arbitration will be English. The arbitral award will be final and binding on the parties.
    • Exceptions. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights or confidential information, without first proceeding to arbitration. Nothing in this Section limits any rights you may have to bring an action in a small-claims-equivalent forum where applicable law permits.

    18. General Provisions

    • Entire agreement. These Terms, together with the Privacy Policy and any additional terms that apply to specific features, constitute the entire agreement between you and Raxha regarding the Service and supersede any prior agreements.
    • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
    • No waiver. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
    • Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
    • No agency. No agency, partnership, joint venture, or employment relationship is created by these Terms.
    • Force majeure. We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, epidemics, network outages, or actions of third-party providers.
